An NHS trust has agreed to pay £187,000 in damages following a ruling by an employment tribunal that found it had harassed seven nurses. The harassment stemmed from the trust’s requirement that these nurses share a changing room with a transgender woman.
The tribunal determined that County Durham and Darlington NHS Foundation Trust fostered a “hostile environment” toward the nurses who opposed Rose Henderson’s use of the single-sex changing facilities. Henderson, who was born male but identifies as a woman, was at the center of the dispute.
One of the nurses involved, Bethany Hutchison, explained that their concerns were raised out of a desire to protect women’s privacy and safety. However, rather than fostering a respectful dialogue, the nurses experienced “pressure and intimidation” from the trust.
Steve Russell, the trust’s CEO, acknowledged that the organisation should have handled the situation differently and expressed regret for the effect it had on those involved. Hutchison, who leads the Darlington Nursing Union, described the tribunal’s decision as a “vindication of our stand for dignity, privacy, and common sense.” She added, “We hope it ensures that no woman is ever again made to feel unsafe in her workplace for speaking the truth.
